Copyright laws and international copyright treaties, as well as other intellectual property laws and treaties protect the Software provided hereby; the Software is licensed, not sold. Upon acceptance of the terms and conditions of this Agreement, Licensor (i-Lighter, Inc.) grants you the right to use the Software in the manner hereinafter provided. Non-commercial Use Only i-Lighter is made available to you for your non-commercial use only. This means that you may use it at work or at home. You may not sell or transfer for profit i-Lighter or any information, services, or software associated with or derived from it. You may not modify, copy (except as provided below), license, or create derivative works from i-Lighter unless approved by i-Lighter, Inc. in writing. In this regard, inquiries may be directed by email to support@i-Lighter.com. Installation Reproduction and Distribution. You may install, reproduce and distribute an unlimited number of copies of the Software provided that each copy shall be a true and complete copy, which shall include and contain all copyright and trademark notices, and shall be accompanied by a copy of this EULA. Copies of the Software may be distributed as a standalone product or included with your own product. The Software is licensed as a single product. Other Rights and Limitations Limitations on Reverse Engineering, Decompilation, and Disassembly. You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble, alter, or otherwise attempt to discover the source code of the i-Lighter Software, provided, however, that if you are located in a European Community member country or any other country which provides rights materially similar to the rights set forth in this proviso, you may reverse engineer or decompile the i-Lighter Software only to the extent that sufficient information is not available for the purpose of creating an interoperable software program and only upon written approval by I-Lighter, Inc. You may not use I-Lighter in any manner that could damage, disable, overburden, or impair i-Lighter's servers. You may not use i-Lighter in an automated manner, or use automated tools to click on or interact with links to advertisers in i-Lighter. You may not interfere with the data transmitted to or from i-Lighter or i-Lighter’s servers. Updates i-Lighter will occasionally provide you automatic updates, upgrades, and add-ons ("Updates") to i-Lighter to improve the Software’s performance. i-Lighter automatically communicates with i-Lighter’s component server on the internet to check for Updates, such as bug fixes, patches, enhanced functions, missing plug-ins and missing components. i-Lighter may download Updates during these communications or when i-Lighter detects a file that requires a component that is currently not installed. These downloads will occur automatically and without any advance notification to you. Privacy and Data Collection I-Lighter does not collect any unique information about you (such as your name, email address, etc.). i-Lighter does not collect or report back to i-Lighter servers any data unrelated to the features used in connection with i-Lighter. i-Lighter does communicate with our servers and may use cookies; it may utilize non-personally identifiable data regarding the context of the page being viewed; aggregated usage and retention information; and other non-personally identifiable information for the purpose of more accurately matching or further monetizing commercially-oriented services or products including directed advertising. By accepting the terms of this License, you agree that we have the right to run such advertisements and promotions without compensation to you. The timing, type, frequency, placement and extent of advertising by us is subject to change and shall be determined by us at our sole discretion. Copyright and Trademark All title and copyrights in and to the Software (including but not limited to any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the Software), the accompanying printed materials, and any copies of the Software are owned by I-Lighter, Inc. You acknowledge that the i-Lighter Software is protected by the copyright and other intellectual property law of the United States and its various States, by the copyright and design laws of other nations, and by international treaties. You agree to treat the i-Lighter Software as you would any other copyrighted material, such as a book. Any copies that you are expressly permitted to make pursuant to the Agreement must contain the same copyright, trademark, and other proprietary notices that appear on or in the i-Lighter Software. You agree to use trademarks associated with the I-Lighter Software according to accepted trademark practice, including identification of the trademark owner’s name. Trademarks can only be used to identify printed output produced by the i-Lighter Software. The use of any trademark as herein authorized does not give you any rights of ownership in that trademark and all use of any trademark shall inure to the sole benefit of I-Lighter, Inc.. You may not change any trademark or trade name designation for the i-Lighter Software. Limited Liability NO WARRANTIES. I-Lighter, Inc. expressly disclaims any warranty for the Software. The Software and any related documentation is provided "as is" without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Software remains with you. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall i-Lighter, Inc. or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this i-Lighter, Inc. product, even if i-Lighter, Inc. has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. Governing Law The Agreement will be governed by the laws of Florida applicable to contracts wholly entered and performable within such state. All disputes related to the Agreement shall be heard in the Broward County Circuit Court, County of Broward, State of Florida, USA. Both you and I-Lighter, Inc. agree to the personal jurisdiction and venue of this Court in any action related to the Agreement. The Agreement will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is expressly excluded. If any part of this Agreement is found void and unenforceable, it will not affect the validity of the balance of the Agreement, which shall remain valid and enforceable according to its terms. Termination of Agreement The Agreement shall automatically terminate upon failure by you or any permitted user/licensee to comply with its terms. The termination of the Agreement shall not preclude i-Lighter, Inc. from suing you for damages for any breach of the Agreement. The Agreement may only be modified in writing signed by an authorized officer of i-Lighter, Inc.
